When getting ready to file for divorce, there are a lot of different complicated factors to think about. For example, in accordance with Section 3011 of the Family Code, either you or your spouse must have resided in California for a minimum of six months and in the county where the divorce complaint is being filed for a minimum of three months prior to submitting your petition to initiate the process of getting a divorce.

 

If you have been residing in another state throughout your marriage, this may be difficult to do, but it is not impossible with the appropriate amount of preparation and planning. According to the California Family Code, there are two distinct categories of divorce: voluntary and involuntary divorce. A court has the entire right to force a spouse to pay support for his or her partner's living expenses if that spouse is refusing to comply with the requirements of the Family Code.

 

If you fail to comply, you risk facing the consequences, such as being found in contempt of court and having to pay fines or perhaps doing time in jail. In the field of family law, the procedures for calculating child support are sometimes referred to as formulae. A formula is used in the state of California to determine spousal support payments. This formula takes into consideration a variety of criteria, including the exact duration of the marriage, each party's income, and any additional spousal support obligations that may exist (if any).

 

According to Family Code, if you are a resident of Southern California, for example, you can be eligible for spousal support payments. This clause of the family law also applies in the event that one spouse gives up their job or lowers the number of hours they work.
